Are there any exceptions or transitional arrangements?
From January 1, 2024, the obligation to use 65% renewable energy (RE obligation) will come into force for new buildings in new development areas, provided that the building application is submitted after January 1, 2024.
For new buildings outside of new development areas and existing buildings, the 65% RE obligation only applies after the deadlines for the municipal heating plans have expired. In concrete terms, this means
In municipalities with fewer than 100,000 inhabitants, the deadline is June 30, 2028.
In municipalities with more than 100,000 inhabitants, the deadline is June 30, 2026.
If the municipal heat planning is available before these deadlines expire, the 65% EE obligation comes into force one month after the official announcement by the municipality. However, this regulation only applies to buildings located in the areas designated by the municipalities.
For municipalities that do not submit a heat plan by the deadlines, the rules apply as if a heat plan were in place.
